Hemptonicx offers this website, including all information, tools and services available from this site to you, the user, under the conditionthat you accept all terms, conditions, policies and notices stated here.

By visiting Hemptonicx website and making a purhase, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including any additional terms, conditions or  policies referenced on our site or those  available by link. These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

By using our site and service you will hold Hemptonicx  investors, directors, officers, employees, interns, affiliates, agents, contractors, suppliers, providors or licensors harmless from any claim or demand including attorney fees resulting from your breach of the Terms Of Service.

Section 14 – Trademark & Copyright

All of the trademarks, graphics, content, video content, photography, java code, website elements, website copy and the name Hemptonicx are our property and copyrighted to us and shall not be infringed upon in any way to market any other products goods or services. Our unique text character alignment and trade design on the name Hemptonicx is proprietary and will not be used in connection with any product or service that is not ours.

Section 15 – Taxes

All applicable sales,  use, excise, gross receipts and other taxes, excluding Hemptonicx business entity related taxes are the responsibility of the Buyer. Any claims from Buyer for exemption from such taxes must be accompanied by a  suitable certificarte of  tax exemption.

Section 16 – Methods Of Payment

Hemptonicx accepts major credit cards Visa, Mastercard and American Express. Should a credit card transaction be declined for any reason, we reserve the right to cancel your order. Orders are only shipped after payment in full has been made. Any associated fees, or processing fees are the sole responsibility of the Buyer. Hemptonicx is not responsible for any charges, errors or losses that may result from Buyer’s payment method.

Section 17 – Shipping

We utilize every effort to try and fullfill your order as quickly as possible, but we cannot guarantee shipping times or deivery dates. We ship only to physical home or business addresses and cannot shipt to PO Boxes. We will incur no liability for lost shipments as that is the responsibility of the carrier. Claims against the carrier are the sole responsibility  of the Buyer and ny claims need to be filed within 15 days of our shipment or it will be our determination that any claims have been forfeited.

Section 18 – THC Disclaimer

Hemptonicx is a provider of industrial hemp extract products. In accordance with current federal legislation the THC levels in all of our products does not exceed 0.3% by weight and complies with all federal regulations. If you use products from our website it is highly unlikely that you would fail a drug test, but not impossible.  Just as the use of Poppy seeds might cause one to fail a drug test, although chances are remote, it is not impossible that one might fail a drug test. You agree to the Terms and Conditions of this site and agree to waive any claims against Hemptonicx for any matters related to failed drug tests or loss of employment.

Section 19 – Refund Policy

I represent that I have read and agree to the full Terms and Conditions of our site and I understand that I will be liable for payment of all product that was shipped to me. The purchaser consents that  jurisdiction over the purchase will be governed by North Carolina Law, should any dispute between the purchaser and the company arise. We want purchasers of our products to be satisfied with our products.  We guarantee your satisfaction for 14 days after purchase. If the product is returned during the 14 day grace period, we will refund your entire purchase price for the products purchased, minus any shipping costs.  We request that you return the unused portion of the product(s) purchased at your shipping expense, and we will refund your purchase price upon receiving the unused portion of the product(s).

Section 20 – Indemnification

You agree to indemnify and hold Hemptonicx our parent, investors, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorney fees as a result of any breach these Terms & Conditions or any other third party entity.

Section 21 – Severability

Should any elements of our Terms & Conditions be determined to be unlawful or unenforcable, the remainder of the Terms & Conditions will still be enforcable to the fullest extent permitted by law. Any unenforcable portion of the Terms & Conditions will be severed from the remaining body of our Terms & Conditions with all other componets still being enforced.

Section 22 – Termination Of Agreement

The Terms & Conditions of our site are in effect until terminated by either you or us. Either of us can terminate our business relationship at any time, for any reason. Buyer may simply stop using our website and purchasing our products in order to terminate our bsuiness relationship. If it is our opinion that you have failed to comply with our Terms & Conditions we reserve the right to terminate this agreement at any time and without any notice and Buyer will still be responsible any unpaid amounts.

Section 23 – Entire Agreement

If for any reason, we do not enforce any component of our Terms & Conditions it does not mean we relinquish the right to enforce the terms as we see fit. Any policies or rules posted by us on this site or in our Terms & Conditions constitutes an agreement between you and us if you use this site.

Section 24 – Arbitration

If any disputes between you and us concerning our Terms & Conditions are not immediately resolvable, we will then seek to resolve the dispute pursuant to the Federal Arbitration Act with a single neutral arbitrator administered by the American Arbitration Association. Any arbitrator decision will be considered final and judgment may be entered upon it in any court having jurisdiction. The prevailing party will be entitled to recover any costs or attorney fees.

Your use of this site will be governed by all applicable North Carolina laws. You agree that any legal proceedings between you and us will be exclusively heard in state and federal courts located in North Carolina and you also waive any right to move the legal proceedings to any other state. Any claims must be commenced within one year after the claim or casue of action accrues. If Buyer fails to conduct the legal proceedings of any dispute outside of the one year time period, it shal signifiy waiving of any associated claims and will be deemed uneforcable. If any part of these Terms and Conditions is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions.

Section 26 – Local Jurisdiction

To the best of our knowledge, Hemptonicx operates legally under both state and federal laws present in the United States. However it is impossible to be aware of all local jurisdiction laws relating to hemp extract products.  Hemptonicx is not liable for any potential legal matters that may arise out of any such local regulations. When you utilize our site and purchase our products, you do so at your own risk and are responsible for compliance with any and all state and federal laws.  By placing an order you agree that it is your responsibility to determine if hemp extract products are legal according to your local, state and federal laws.

Statements on this website have not been evaluated by the Food and Drug Administration. All products sold on Aleafiate are not intended to diagnose, treat, cure, or prevent any disease.
